These Terms of Use (the "Terms") govern the use of the Trublion mobile application (the "Service") by any person who uses it as a reader (the "User").
Using the Service constitutes full and unreserved acceptance of these Terms. If the User does not accept these conditions, they are invited not to use the Service.
Trublion is a service published by Trublion that connects independent booksellers and their readers. Through the mobile application, the User can:
The Service is offered free of charge to reader Users.
The Service is accessible without creating an account or entering any identity information. When the application is opened for the first time, an anonymous technical identifier is generated locally on the User's device. This identifier is not linked to any personal data (no email, name, or phone number) and does not allow the User to be identified.
The application is distributed via the Apple App Store and the Google Play Store. Its installation, updates and operation on the User's device are also governed by the general terms and conditions of these third parties, which are independent of these Terms.
The application requires a recent version of iOS or Android. Trublion does not guarantee compatibility with all devices or all operating system versions.

The application may send push notifications to the User to inform them of new publications from their followed bookshops. Push notifications are opt-in: they are only activated with the User's explicit consent at the first system prompt.
The User may disable notifications at any time from their device settings or from the application settings.
Feed persistence principle. Disabling notifications does not affect the availability of content in the application: any publication from a followed bookshop remains accessible in the personalised feed, regardless of whether notifications are actually delivered.
When the application is first opened, the User's IP address is read on a transient basis in order to suggest bookshops in their region. This resolution relies on a GeoLite2 database (MaxMind) downloaded onto Trublion's servers, without any call to a third-party service regarding the User. The IP address is neither stored nor linked to an identifier.
The User may at any time enable precise geolocation from their phone settings to benefit from distance-based sorting. This choice may be revoked at any time in the same way.
The User may send a message to a bookshop to notify their interest in a book. This message transmits to the bookseller the first name entered by the User along with the reference of the book concerned, for the exclusive purpose of informing the bookseller with a view to a possible visit by the User to the shop.
This notification of interest does not constitute a reservation, an order, an offer, or an acceptance within the meaning of the rules governing contract formation, namely Articles 1113 and following of the French Civil Code. It creates no contractual or pre-contractual obligation on the part of the User, the bookshop, or Trublion. In particular:
Any collection of the book, its payment and delivery take place exclusively and directly at the bookshop, under the conditions of the bookshop concerned and independently of the Service. Trublion is not a party to any transaction that may take place at the bookshop.
The content of publications (texts, reviews, descriptions) is the property of the booksellers who publish them. The User is only authorised to reproduce or redistribute such content strictly within the scope of private use.
Book covers displayed in the Service are used for informational purposes, in accordance with the right of quotation and the exception applicable to short extracts.
Content uploaded by the User (in particular cover photos added manually when saving a book to their selection) is not subject to prior moderation. In the event of a report of content infringing the rights of a third party, Trublion will review it and remove it if appropriate, in accordance with Article 9 of these Terms.
The Trublion application, its design, brand, logos and databases are the property of Trublion, protected by French and international intellectual property laws. Any unauthorised reproduction or use is prohibited.
In accordance with Article 16 of Regulation (EU) 2022/2065 (Digital Services Act), any User or third party, whether or not they are a user of the Service, may report content they consider unlawful using the dedicated form accessible at /signaler-contenu, or by email to abuse@trublion.co.
The report must specify the nature of the content in question, its precise location within the Service (URL or identifier), the reasons why the person making the report considers the content unlawful, and, where possible, their contact details. Trublion will acknowledge receipt of the report as soon as possible and will review it with due diligence. The reasoned decision will be communicated to the person who made the report and, where applicable, to the bookseller concerned.
The User may, at any time, request the deletion of data associated with their device by contacting Trublion via the dedicated form or by email at dpo@trublion.co. The processing of personal data and the exercise of rights provided for under the RGPD are detailed in the Privacy Policy.
In the absence of an explicit request, data associated with a device that has been inactive for more than 12 months will be deleted automatically.
The Service is provided "as is". Trublion does not guarantee uninterrupted operation, freedom from errors, or full compatibility with all technical environments.

The processing of personal data in connection with the Service is governed by the Privacy Policy, which forms an integral part of these Terms.
Trublion reserves the right to amend these Terms. Minor amendments (editorial corrections, updates to contact details) take effect upon publication. Substantial amendments will be notified within the application before they take effect, where technically possible given the anonymous nature of the Service.
Continued use of the Service after an update constitutes acceptance of the new conditions.
These Terms are governed by the applicable law, namely French law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the competent court, namely the competent courts of Paris (France), without prejudice to the mandatory consumer protection rules applicable in the User's country of habitual residence.
